The Guardian MarketPerform is an individual single premium deferred registered index-linked annuity contract issued by Guardian Insurance & Annuity Company that is designed to help you invest your money on a tax-deferred basis for retirement or other long-term financial purposes. The Contract may not be appropriate if you have a short time horizon and intend to take early or frequent withdrawals.

Waivers

Death

We pay the Death Benefit amount to your beneficiary(ies) free of surrender charges.

Nursing Home

Unavailable in states: CA

We will waive a surrender charge that would otherwise apply to a withdrawal or surrender if any owner who was age 75 or less on the Contract Date is confined to a nursing home or hospital facility for at least 90 consecutive days pursuant to a qualified physician’s diagnosis that such confinement is medically necessary.

Terminal Illness

Unavailable in states: CA

We will waive a surrender charge that would otherwise apply to a withdrawal or surrender if any owner is diagnosed with a terminal illness by a qualified physician and is not expected to survive more than 6 months.

Premium Notes

The minimum premium payment is $25,000. We require prior approval for a premium payment of less than $25,000 or more than $1,500,000 for ages 75 and younger and $1,000,000 for ages 76 and older at the time of application (which includes the single premium payment under the Contract together with any premium payments under other contracts with the same Owner or Annuitant). Additional premium payments are not permitted under the Contract.

Withdrawal Provisions

Free withdrawal amount
The free withdrawal amount is equal to 10% of the Contract Value on the prior contract anniversary each year and is not cumulative. In the first contract year, the free withdrawal amount is equal to 10% of the single premium. The free withdrawal amount is reduced by any prior withdrawals, including RMDs, taken during the contract year.
